1. Acceptance of Terms

By downloading, installing, or using Capture (“the App”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

Capture is a territory-claiming game that uses GPS tracking to convert your outdoor running and walking routes into claimed territory on a shared map. The App includes features such as territory capture, leaderboards, friend systems, events, brand zones with rewards, and activity tracking.

3. Account Registration

• You must sign in using a Google or Apple account to use the App
• You are responsible for maintaining the security of your account
• You must provide accurate information during registration
• You must be at least 18 years of age to use the App

4. Acceptable Use

You agree not to:

• Use the App while driving or operating a vehicle
• Spoof or manipulate GPS data to claim territory fraudulently
• Use automated systems or bots to interact with the App
• Harass, threaten, or abuse other users
• Use the App in a way that violates any applicable laws
• Attempt to reverse-engineer, decompile, or tamper with the App

5. Territory and Gameplay

• Claimed territories are virtual and do not confer any real-world property rights
• Other players may overlap and capture your territories as part of normal gameplay
• We reserve the right to reset, modify, or remove territories at any time
• Leaderboard rankings are calculated based on gameplay data and may be adjusted to prevent abuse

6. Brand Zones and Rewards

• Brand zones and associated rewards are provided by third-party partners
• Reward availability, terms, and conditions are determined by the respective brand partners
• We are not responsible for the fulfillment of third-party rewards
• Brand zones may be added, modified, or removed at any time

7. Location Data

The App requires access to your device's GPS to function. By using the App, you consent to the collection of precise location data during active capture sessions. See our Privacy Policy for details on how location data is handled.

8. Safety

You are solely responsible for your physical safety while using the App. Always be aware of your surroundings, follow traffic laws, and do not trespass on private property while capturing territory. Capture is not responsible for any injuries, accidents, or damages that occur while using the App.

9. Intellectual Property

All content, design, code, and branding in Capture are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our sole discretion. You may delete your account at any time from within the App.

11. Disclaimer of Warranties

The App is provided “as is” without warranties of any kind. We do not guarantee that the App will be error-free, uninterrupted, or that GPS accuracy will be perfect at all times.

12. Limitation of Liability

To the maximum extent permitted by law, Capture shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

13. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the App after changes constitutes acceptance of the updated terms.
